Terms of Use for the Private Platform

1. Ownership and Access

The DAVATEL private platform is managed by PLATAFORMA DE TRANSACCIONES ELECTRONICAS TODORECARGAS, S.L.U. Access is reserved for authorized users: administrators, distributors, and wholesalers.

Professional use is subject to the contract and the current terms, as identified by their version. The privacy policy provides information on data processing; reading it does not constitute consent to receive advertising or to have data used for other purposes. Essential technical cookies do not require consent, and opting into advertising is not a condition for accessing the platform.

2. Registration and First Access

Distributors and wholesalers must expressly accept the terms and conditions upon registration or when activating their user account, as well as upon their first access to the platform, if configured to do so.

PLATAFORMA DE TRANSACCIONES ELECTRONICAS TODORECARGAS, S.L.U. may request documentation to verify identity, legal representation, business activity, tax information, bank account details, or compliance with requirements before activating an account or paying out commissions.

3. Credentials

Access credentials are personal and non-transferable. Users may not share their username and password with unauthorized third parties.

Distributors or wholesalers may allow authorized employees to use the platform, provided that they do so under their own responsibility and ensure that such employees comply with the same obligations regarding confidentiality, data protection, and proper use.

4. User Roles

• Administrator: May access the information necessary to manage users, registrations, documents, rates, commissions, and the operation of the platform.
• Distributor: May only access their own registrations, clients, documents, and commissions, unless otherwise expressly authorized.
• Wholesaler: You may access information regarding the distributors assigned to your network.

5. Customer Data and Documents

The user entering data into the platform guarantees that the information is accurate, that the customer has been informed, and that the user possesses sufficient authorization to input the data and process the application.

Documents such as national ID cards (DNI/NIE), tax identification numbers (CIF), tax registration forms (Form 036), signed contracts, and bank statements or IBAN documentation may be uploaded, provided they are necessary for processing the application.

It is prohibited to upload documents that have been tampered with, are forged, are unnecessary, or are unauthorized.

6. Permitted Use of the Platform

The platform must be used exclusively for managing applications, customers, rates, service activations, commissions, support, and operations related to the authorized business activity.

It is prohibited to use the platform for unrelated, illicit, or fraudulent purposes, unauthorized commercial activities, deceptive customer acquisition, or the processing of data without permission.

7. AI Assistant

The platform’s AI assistant provides guidance. Its responses may contain errors and do not replace confirmation from a human, commercial, legal, or technical representative, or the service operator.

Do not enter national ID numbers (DNI), IBAN numbers, documents, credentials, or any other identifying customer data into the AI ​​assistant. Documentation must be submitted solely through the designated forms. A recommendation from the AI ​​assistant does not constitute a formal contract, nor does it authorize any actions on behalf of the customer.

8. Rates, Coverage, and Contracting

The rates, prices, promotions, coverage, and terms displayed on the platform are for guidance purposes only and are subject to change. The final contract will depend on the relevant operator, wholesaler, or partner.

The period during which commissions may be reclaimed is 6 or 12 months from effective activation, depending on the operator or provider and the terms of the service, plan or campaign. Check the specific period in the transaction’s particular terms before processing it. This period is independent of any minimum commitment the customer may have with their operator. 9. Suspension or cancellation of access

PLATAFORMA DE TRANSACCIONES ELECTRONICAS TODORECARGAS, S.L.U. may suspend, limit, or cancel the access of distributors, wholesalers, or users in the event of non-compliance, fraud, misuse, provision of false data, serious complaints, non-payment, improper business practices, reputational damage, or risk to the platform.

10. Security and traceability

The platform may record access, actions, changes, IP addresses, dates, and user activity for purposes of security, control, support, fraud prevention, and defense against claims.

11. Modification of terms

These terms may be modified when necessary; the new version will be published on the website or platform, and authorized users will be notified where appropriate.

DAVATEL provides shops, businesses, self-employed professionals, distributors, and authorized wholesalers with tools to prepare proposals and manage applications, documentation, and commissions. Telecommunications is our core activity; we also handle assessments and applications for electricity and gas services. Alarm systems, insurance, and equipment leasing (renting) are upcoming services; please note that these cannot be contracted until they are officially launched and their specific terms and conditions are in place.

Public information and guides are accessible to everyone. The plan calculator and professional operations require an authorised account. The platform does not replace the operator or energy supplier providing the service.
